Once the authorization form has been submitted along with the royalty agreement, our Artwork Approval/Color Option form will be created from submitted artwork or artwork from our database. Vinyl Mayhem is constantly creating dozens of new designs based on our own ideas and from artwork submitted from customers. If a design is discovered to conflict with any copyrighted or trademarked design, we request to be notified in writing as soon as possible. Vinyl Mayhem will investigate all intellectual property manner inquiries in an expedient manner. FAIR USE The U.S. Supreme Court has ruled in the fair use of a trademark’s name as a protected part of The First Amendment guaranteeing the right to free speech. Specifically referring to vinyl graphics, signage and advertising: A brand name/registered trademark can be used as long as it does not utilize the same typeface as the distinctive mark. For example: I love my Toyota utilizing a generic font and not the Toyota® typeface or logo or a LAKER FAN sign which does not use the Lakers® organization emblem are acceptable under the law. |
